DOC// Prosecutor who ordered the surveillance of Maia Sandu fails to overturn suspension from office

Prosecutor Dumitru Raileanu, who is on trial alongside Prosecutor General Alexandr Stoianoglo for abuse of office in the case involving the release and withdrawal of charges against Veaceslav Platon, has lost in the first instance the lawsuit in which he contested his suspension from office. Judge Igor Barbacaru rejected his claim, deeming it unfounded. However, the decision, issued on June 11, can be appealed to the Chișinău Court of Appeal – Center within 30 days.

Raileanu’s name appeared in the case concerning the surveillance of opposition politicians, civic activists, and journalists during the government of Vladimir Plahotniuc. After Alexandr Stoianoglo was appointed Prosecutor General, Raileanu and two of his colleagues involved in the surveillance were removed from criminal prosecution.

In November 2021, journalists from Nord News published a prosecutorial order signed by Dumitru Raileanu, which authorized the surveillance of Maia Sandu in 2018. Raileanu justified the measure by claiming that Sandu had allegedly “incited citizens to mass disorder.”

“Maia Sandu is inciting citizens via social media to mass disorder and to the violent overthrow or change of the constitutional order,” reads the justification of the decision issued by the prosecutor who gave the green light to Sandu’s surveillance.

In March 2022, Dumitru Raileanu was suspended from his position as a prosecutor within the Prosecutor's Office for Combating Organized Crime and Special Cases (PCCOCS). At the time, Raileanu stated that the actions taken against him were abusive.
