The Court of Appeal Centru has returned the appeal filed by the Ministry of Justice against the decision of the Chișinău Court, Centru office, dated July 22, 2024, in the case of moral and material damage compensation initiated by former prosecutor Lilian Rudei. Now a lawyer, the ex-prosecutor won 30,000 lei in compensation in the first instance after his criminal prosecution, initiated by a decree from former Prosecutor General Alexandr Stoianoglo, was dropped. Both the plaintiff and the Ministry of Justice appealed the first-instance court’s decision.
The complaint reached the judges on May 19, 2023. In his argument, Rudei stated that on January 10, 2020, a criminal case was initiated against him by Alexandr Stoianoglo’s decree, accusing him of abuse of office and interference in the administration of justice and criminal prosecution.
Later, Stoianoglo requested an extension of Rudei’s suspect status for three months. By decree on July 28, 2020, Rudei was cleared of charges, as the case lacked the elements of a crime. As a result, he was subjected to an unwarranted criminal investigation for six months. Moreover, he was allegedly forced to leave the prosecution system amid the conflict between the General Prosecutor's Office, led by Alexandr Stoianoglo, and former head of the Anticorruption Prosecutor’s Office, Viorel Morari.
The first-instance court ordered compensation totaling 30,000 lei, of which 20,000 lei was for moral damages.
In December 2022, the Supreme Court of Justice declared inadmissible the appeal filed by the former prosecutor, in which he sought the annulment of the order for his dismissal. He claims he was forced to resign under pressure from Alexandr Stoianoglo.
Lilian Rudei has been the subject of several journalistic investigations due to generous donations from his relatives. In 2012, his parents donated 145,000 lei to him, in 2014–2016, they gave him 5,100 euros each year, and in 2017, they gave him 93,000 lei. That same year, he sold his car to none other than his own father for 80,000 lei, then bought another vehicle for 10,000 euros.
Upon leaving the system, Rudei declared an annual salary of 514,000 lei, a 125-square-meter villa, a Toyota Sienna car valued at 10,000 euros, and a bank debt of 170,000 lei.
