Suspense in the "Magistrates File": Justice in the Hands of Supreme Court Magistrates

One of the victims in the 'Magistrates File' has appealed to the Supreme Court of Justice (SCJ) regarding the verdict issued by the Appellate ourt, which concluded that there was no evidence of a crime in the actions of magistrates Svetlana Tizu, Victoria Hadîrca, Ludmila Ouș, Galina Moscalciuc, and Liubovi Brînza. The appeal was filed on Monday, October 9th. Anticoruptie.md has conducted an analysis of the careers and high-profile cases handled by these five judges who were embroiled in a bribery scandal in exchange for issuing favorable rulings. The "Magistrates File", involving ten individuals, including five judges, a prosecutor, a lawyer, a legal assistant, a doctor, and a defendant in another case, was brought to trial by the Anti-Corruption Prosecutor's Office in April 2019. According to the anti-corruption prosecutors, the five female judges are alleged to have demanded and received substantial sums of money to issue favorable rulings in several pending criminal cases.

Also implicated in the same case was obstetrician Vadim Scarlat from the Mother and Child Institute, linked to the unfortunate death of a newborn. He was accused of transmitting 2,000 euros to a magistrate through a court clerk to avoid punishment in a medical malpractice case. Dr. Vadim Scarlat admitted his guilt in corrupting the magistrates and was subjected to a simplified trial, resulting in a fine of 115,000 lei.

On March 17, 2021, all five accused judges in the so-called "Magistrate's file"—Svetlana Tizu, Victoria Hadîrca, Ludmila Ouș, Galina Moscalciuc, and Liubovi Brînza—were acquitted after it was determined that no criminal offense had occurred. In June of the same year, the Comrat Court of Appeals upheld the original court's decision.

In August, the Superior Council of Magistracy (CSM) partially approved the reinstatement of Judge Liubovi Brînza to her position, along with all her previously held rights. Despite the judge's request to postpone the hearing due to her absence from the country, CSM members rejected the request, obliging her to return to the country and resume her duties. On the other hand, the review of Svetlana Tizu's reinstatement request at the Chisinau District Court was postponed to a later session."
