The Chisinau Court of Appeal, on June 7, refused to lift the seizure on the land owned by "Prosport Invest" SRL, which holds a lease on the territory of the sports club Dinamo. Magistrate Ana Popov delivered this decision. The applicant has been given 10 days to pay the state tax, after which the court may proceed with the action. Anticorupție.md has revealed that the lease contract, which could potentially transfer the land to the company's management indefinitely, has raised concerns among several oversight institutions due to the potential risk of alienating public property, resulting in a loss of 58 million lei for the state treasury.
The company lodged a summons with the Anticorruption Prosecutor's Office after the real estate was seized by the investigating judge. The initial court dismissed the company's claims as unfounded in March 2022. In September, "Prosport Invest" filed an appeal with the Chisinau Court of Appeal.
On June 7, the panel of the appeals court decided not to grant the request, citing the applicant's failure to meet all the imposed requirements. The court stated that proof of payment of the state tax amounting to 75 lei needed to be presented within 10 days of receiving the decision.
"Prosport Invest" is a newly established company, founded on November 18, 2015. Just 23 days later, it signed the rental contract. The SRL is owned by businessman Viorel Bodiu, a former football player and close friend of the former director of the Dinamo club, Arcadie Bostan, who co-signed the transaction on behalf of the Ministry of the Interior. Between the contract's effective date and 2019, SRL "Prosport Invest" constructed 11 buildings on the leased land, raising questions about the true purpose of the project and possible hidden interests.
After completing the constructions, "Prosport Invest" immediately requested a positive opinion from the Public Property Agency for the preparation of a feasibility study to determine the land area required for the technological process related to private real estate for subsequent sale-purchase. This request was dismissed but indicates the company's attempts to seize the land.
In 2020, even though the lease contract did not specify that ownership of the constructed buildings could be transferred to the SRL, "Prosport Invest" obtained recognition of private ownership for the 11 properties by registering them in the real estate register. This created uncertainty about the fate of the land on which the buildings were constructed, making it more difficult to remove the owner from the location after investing millions of lei.
The General Prosecutor's Office stated to Anticorupție.md that there are reasonable suspicions of misconduct in office, and the case is currently under criminal investigation. Additionally, a seizure was applied to the real estate based on the conclusion of the investigating judge.
Concurrently, the sports club "Dinamo" has filed a court request to declare the rental contract null and void and to remove the entries from the Real Estate Register.
On the other hand, Iuliana Pascal, the jurist representing "Prosport Invest" in court, argues that the contract was for a dilapidated piece of land. She claims that her client, Viorel Bodiu, who is also the president of the mini-football federation, built a sports complex "for his personal satisfaction" using his own funds because of his background as a sportsman and his desire to promote the development of mini-football.
