Evidence exchange with 63 Countries. Moldova unlocks its ability to investigate high-profile cases

The Republic of Moldova is joining the Convention on the Taking of Evidence Abroad in Civil or Commercial Matters, adopted in The Hague. A draft law providing for this was adopted by the Parliament.

The Convention aims to strengthen and modernize procedures for obtaining evidence abroad, contributing to the unification of rules and the application of its provisions, even in cases where the Republic of Moldova has not concluded bilateral agreements on legal assistance in this field.

As a party to the Convention, Moldova will have the right to request the collection of evidence abroad through letters rogatory, as well as receive assistance from competent authorities in other countries for obtaining evidence in civil or commercial proceedings. Moldova will also be able to use diplomatic agents or consular officials to obtain evidence, under certain conditions.

At the same time, the Convention sets specific obligations – to cooperate with contracting states in the collection and administration of evidence in civil and commercial matters; to comply with the legal procedures and requirements for the transmission and execution of letters rogatory; to accept and execute such letters, etc.

Currently, 63 countries are signatories to the Hague Convention on the Taking of Evidence Abroad in Civil or Commercial Matters.
