Audiovisual Сouncil wins in the first instance, after being sued by NTV Moldova

The Audiovisual Council  has won the case in the first instance regarding the way NTV Moldova reflected the Russian aggression on Ukraine. The court deemed unfounded the request of "Exclusiv Media" SRL, the founder of the television station NTV Moldova, to cancel two fines amounting to 10 thousand lei and four public warnings. These penalties were imposed by th Audiovisual Council the  in March 2022 due to the presentation of the security crisis in the region and the invasion of Ukraine by the Russian Federation. The court ruled that NTV Moldova provided a unilateral and insufficiently documented account of the situation, mixing facts with opinions, which did not favor the free formation of opinions.

Anticoruptie.md has revealed that TV stations whose licenses were suspended by the Commission for Exceptional Situations (CSE) for providing incorrect information about national events and the war in Ukraine have migrated to the frequencies of other TV stations along with their teams and editorial policies. NTV Moldova has moved to EXCLUSIV TV, RTR Moldova to Cinema 1, and TV6 to ORIZONT TV.

According to the Audiovisual Council, the sanctions were imposed following the monitoring of NTV Moldova, which showed that the TV station consistently presented the situation in Ukraine in a biased manner, failing to promote the free formation of opinions.

On February 24, 2022, in the first news bulletin of the day, NTV Moldova presented statements attributed to Ukrainian President Volodymyr Zelensky without factual support. Additionally, in the Russian-language news bulletin, a statement from the Russian Ministry of Defense was featured.

In the subsequent day's news bulletin, the Audiovisual Council observed a mix of facts and opinions, as well as "incomplete documentation and information presented in a biased and bad faith manner" regarding the Ukrainian president's call for negotiations and the alleged withdrawal of support by the West. During the four days of monitoring, NTV Moldova failed to present the position of the West and only briefly included an intervention by the French Ministry of Defense stating that no one wants a war with Russia.

The subject of refugee accommodation in the news bulletin on February 25, 2022, also exhibited a mixture of facts and opinions and insufficient documentation. The journalist stated that "Ukrainians regret that their country was pushed to this critical situation, and when everything caught fire, those who declared themselves partners, ran away," without verifying the statement or allowing anyone to respond. Although the report did not pose a question, the way in which people provided answers indicated that they were asked to give their opinion about Ukraine not receiving any assistance.

The  Audiovisual Council further noted that NTV Moldova resorted to omission when, in the summary bulletin of the week on February 27, 2022, out of 12 news items, three referred to the war in Ukraine. However, all of these reports were repetitions of previously aired information, lacking updates and violating principles of accurate reporting. Similarly, NTV Moldova failed to explain the establishment of the state of emergency in Moldova. According to Aneta Gonța, the vice-president of the Audiovisual Council , this omission resulted in incomplete, distorted, and one-sided information for the audience of NTV Moldova. Consequently, the viewers were not adequately informed about the events in the neighboring country starting from February 24, 2022, hindering the formation of an unbiased opinion.

The court's decision can be appealed within 30 days.
