Supreme Council of Magistracy fields Mihai Poalelungi for presidency of Supreme Court of Justice

After four years, the Supreme Council of Magistracy (CSM) nominated again Mihai Poalelungi as the chairman of the Supreme Court of Justice (CSJ).  The decision was taken at CSM meeting on February 9, by nine votes in favor. Council member Tatiana Raducanu was against, while Dumitru Visternicean did not participate in the deliberations. Poalelungi was re-elected at CSM in the context of the protests at the institution and discontent of civil society to the reforms promoted by Mihai Poalelungi. 

The election of the chairman of CSJ was held with scandal and protests staged at the Supreme Council of Magistracy. In the morning, the police formed a cordon at the entrance of CSM, thus they blocked the access of several protesters to the meeting aimed to discuss the candidacy of Poalelungi.  Among them were the supporters of the Civic Platform Dignity and Truth and Our Party members. President of CSJ was booed by the crowd, being labeled as a person of the controversial Vlad Plahotniuc. After a break for a few hours, CSM members returned to the meeting and voted for Poalelungi. "Micu (Victor Micu, president of CSM - n.r.), you're a scum!", "Down the hunt!" "Poalelungi, do not forget, prison is your house!", chanted the protesters.

"Since I have come into the system, a controlled defamation towards me, some judges and the entire system has been started", said Poalelungi at the CSM meeting. 

Candidacy of Mihai Poalelungi will be discussed in the Parliament. Under the procedure, the Supreme Court judges are appointed by the Parliament at the proposal of the Superior Council of Magistracy, within 30 days from the date of proposal registration.

In a message published by the U.S. Embassy on a social networking site, Ambassador James Pettit asks: "What’s happening at the Supreme Court of Magistrates? A single inside candidate? Is this what judicial sector reform is supposed to look like?".

Mihai Poalelungi has been chairman of CSJ since February 2012. The magistrate submitted his candidacy, though several months ago he said in an interview for the portal Anticoruptie.md that he was not sure that he wanted to be re-elected. "I'm not sure if I want another term at the Supreme Court of Justice. I will see", said Mihai Poalelungi in September 2015.

President of CSJ has been in conflict with civil society for several months, after the Center for Judicial System Reform managed by Mihai Poalelungi proposed a package of legislative initiatives which, according to experts, would overturn the reform in the judiciary. A number of recommendations from the list of 17 are included in the PhD paper of the CSJ president.
