Ilan Shor's lawyers filed an exception of unconstitutionality, requesting the interpretation of an article from the Code of Criminal Procedure which stipulates that the magistrate cannot participate in the trial and is to be challenged if "there are other circumstances that reasonably question the judge's impartiality". Until the ruling of the Constitutional Court, the examination of the Shor case was suspended.
The decision in the Shor case had to taken by three magistrates: Evghenii Dvurecenschi, Nina Veleva and Vitalie Movilă. On January 26, the members of the Superior Council of Magistracy approved the resignation request of judge Nina Veleva, who is the rapporteur in the Shor case.
