The life of an oligarch in the Republic of Moldova is changing.

Representatives of the Ministry of Justice have discussed the legal aspects related to the criteria for recognizing a person as having excessive influence in public life, i.e., an oligarch, with experts from the Venice Commission. The Venice Commission is scheduled to issue an opinion on the so-called Deoligarization Law at its next session in March 2023.

The Minister of Justice, Veronica Mihailov-Moraru, thanked the Venice Commission experts for their cooperation and constructive discussions on the draft law. This measure is intended to prevent the excessive influence of private interests on public life and state institutions.

"The recommendations of the Venice Commission on the initiatives we are putting forward are valuable and allow us to improve the draft laws to align with all the standards and demands related to justice and human rights," said the Minister of Justice, Veronica Mihailov-Moraru.

The new law will provide elements for defining people considered to have excessive economic and political weight in public life (oligarchs). This includes citizens of the Republic of Moldova who are or have been involved in political life in the present or the last five years, exercise or have exercised in the last five years an excessive influence or pressure on some state authorities/exposed persons political, exert a significant influence on the mass media, have a confirmed value of personal assets and commercial entities in which they are a beneficiary, which exceeds the amount of 50,000 average monthly salaries forecasted for the economy, etc.

Two other proposed criteria are being considered: a person who has been convicted of committing corruption crimes or acts related to corruption or is the subject of restrictive international measures imposed through the resolutions of the Security Council of the United Nations Organization, acts of the European Union, acts and decisions adopted by other international organizations, or other states, as well as by the Republic of Moldova on its initiative.

The law also proposes the creation of the Deoligarization Committee (CD), which will convene whenever notified by a responsible institution/interested person and will have the competence to examine and verify notifications regarding persons who exercise significant economic and political influence in the public and economic life of the country.

If recognized as oligarchs, they will be unable to finance political parties and/or electoral campaigns, participate in the privatization of public property, receive public goods in concession, or conclude public-private partnerships, and finance or organize meetings or demonstrations with political claims.
