Magistrate, awaiting justice from the ECHR, after two disciplinary sanctions applied 10 years ago: "I don't want money"

The vice-president of the Chisinau Court, Angela Catană, is awaiting the decision of the European Court of Human Rights (ECHR) in the hope that she will get rid of the two severe reprimands applied 10 years ago for the amnesty of a rapist and the cancellation of an order for initiation of criminal prosecution. The magistrate's request was communicated by the European Court to the Chisinau Government.

Asked by the reporters of the Anticoruptie.md portal, Angela Catană declared that the two disciplinary sanctions were unjustifiably applied to her by the Superior Council of Magistracy. "I am a veteran of justice and image is very important to me. I was harassed by the former General Prosecutor, Valeriu Zubco, who interfered in justice, defending certain interests. I got rid of him after the Pădurea Domnească scandal, in which he was involved and had to resign. But the sanctions remained. A judge cannot be disciplined for his opinions on the decisions taken, it is against the law. I do not want money. I want justice to be done and want to be rehabilitated", Angela Catană told us.

We remind you that, by Decision no. 48/12 of 07.10.2011, the disciplinary sanction was applied to Angela Catană in the form of a "severe reprimand". The Disciplinary Board came to the conclusion that the magistrate improperly applied the provisions of Article 5 of the Amnesty Law. The Board justified its decision by the fact that the amnestied person did not have the status of a convict as provided by art. 65 of the Code of Criminal Procedure and amnesty could not be applied to him without his guilt being established.

In June 2012, Angela Catană was given a second disciplinary sanction in the form of a "severe reprimand", at the request of Valeriu Zubco, for canceling an order for initiation of criminal prosecution in a case of embezzlement.
