Ex-Deputy from PCCOCS, Vitalie Busuioc, kept away from the legal profession

The Chisinau Court of Appeal has overturned the decision of the first instance that admitted the request of Vitalie Busuioc, the former Deputy Chief Prosecutor of the Prosecutor's Office for Combating Organized Crime and Special Cases (PCCOCS), against the Lawyers' Union of the Republic of Moldova. Now, the Supreme Court is his only remaining option to access the legal profession. During Busuioc's tenure, he also managed a case related to fraud, money laundering, and the abuse of office, initiated in November 2015 against five individuals, including Alexandru Gusev, the director of MoldovaGaz. Anticoruptie.md uncovered the collaboration agreements signed between companies established by Moldovagaz and firms affiliated with the family of Alexandru Gusev, who serves as the president of the company's Board of Directors, during the period 2012-2015. These agreements saw private and "independent" economic entities certifying natural gas meters distributed to consumers and verifying the quality of natural gas on Moldovan territory. Additionally, all natural gas distribution companies under the management of Moldovagaz held certificates of conformity for natural gas quality issued by a company controlled by Gusev's family members.

On February 10, judges at the Chisinau Court's Rîșcani headquarters accepted a summons request submitted by the former prosecutor in an  administrative litigation. The decision issued by the Licensing Commission of the legal profession was also revoked. As a result, the Union of Lawyers from the Republic of Moldova was compelled to issue an individual favorable administrative act allowing Vitalie Busuioc's candidacy in the legal profession based on Article 10 of Law no. 1260-XV regarding the legal profession, along with the issuance of a license to practice law.

On October 10, the Chisinau Court of Appeal ruled to annul the trial court's decision, providing the right to appeal to the Supreme Court of Justice.

Busuioc was appointed to his position in 2017 for a five-year term but submitted a request for resignation on his own initiative on January 30, 2020. The prosecutor gained public recognition through his involvement in the case concerning the attempted assassination of the Democratic leader, Vlad Plahotniuc. Additionally, he oversaw the criminal case initiated against Renato Usatii in connection with the attempted murder of Gherman Gorbunțov. The prosecutor was accused of acting on a political directive. Reporters from the Center for Investigative Journalism of Moldova (CIJM) obtained a document revealing that Gherman Gorbunțov, a controversial Russian banker involved in money laundering schemes, obtained another Moldovan passport in the name of Ivan Piotr Kirov at the request of the Intelligence and Security Service (SIS).
