The "Turkish teachers" file could be re-examined

The Chisinau Court of Appeal, on Thursday, February 16, decided to refer the ordinance issued by interim deputy Victor Plugaru, which terminated Galina Tufekci's participation as an injured party, to the Chisinau Prosecutor's Office. Tufekci is the wife of Feridun Tufekci, one of the expelled Turkish teachers who is seeking a retrial of the case in the trial court. The court accepted Tufekci's complaint, and her rights violation will be rectified. The decision can be appealed to the Supreme Court of Justice, but the Court of Appeal's ruling provides a chance for this case to be reconsidered. Anticoruptie.md has extensively covered the subject of the teachers' expulsion from "Orizont" high school, and has discovered exclusively that the Ministry of the Interior backdated the expulsion documents. The court has ordered the restitution of the fine for the rights violation, and the criminal case has been referred to the Prosecutor's Office.

On September 5, 2018, the seven Turkish teachers who worked at "Orizont" high school were declared undesirable due to their alleged connections with an Islamic group. In less than 24 hours, they were deported to Turkey, where they were subsequently imprisoned.

On September 5, 2018, the day before the teachers' deportation, the Migration and Asylum Office declared them undesirable on the territory of the Republic of Moldova. "In accordance with the provisions of article 55 of Law no. 200 of 16.09.2010 regarding the regime of foreigners, I decide to declare Riza Dogan, a citizen of Turkey, an undesirable person on the territory of the Republic of Moldova for a period of five years," the decision of the institution stated in the case of the former director of the Durlesti branch of "Orizont" high school.

Later, the Anticoruptie.md portal obtained documents proving that the Ministry of the Interior had falsified the documents one day earlier in order to cover up the illegalities committed by the Chisinau authorities when they expelled and handed over the seven teachers to the Turkish authorities.

On June 11, 2019, the European Court of Human Rights condemned the Republic of Moldova for violating the rights of Turkish citizens who were expelled to Turkey. More than three years after the ECHR decision, the Migration and Asylum Office announced that it had reviewed the documents issued in the case of the Turkish citizens.

"After re-examining the documents and taking into account the factual and legal circumstances, the decisions declaring foreigners as undesirable persons issued regarding citizens of the Republic of Turkey have been annulled," the institution stated in a press release. Therefore, the quoted source emphasized, the foreigners in question have the right to enter and stay in the territory of the Republic of Moldova. The file on the expulsion of the Turkish teachers was declassified after four years during which no details were disclosed.

The former director of the SIS, Vasile Botnari, admitted his guilt and was sentenced to a suspended sentence. He paid the damages of 125,000 euros imposed by the ECtHR and an additional 380,000 lei for the charter plane used to transport the teachers to Turkey.

Anticoruptie.md also reported that Vasile Botnari, the former director of the Intelligence and Security Service (SIS) and the only Moldovan official convicted in the case of the expulsion of Turkish teachers, lives in a luxury home located on three plots of land intended for construction in an elitist neighborhood in Chisinau. Both the land and the buildings became Botnari's property while he held high positions of public dignity, as he was one of Vladimir Plahotniuc's close associates and protégés. Despite living there for many years, the former civil servant never declared his properties, which are registered in the name of his in-laws. Vasile Botnari does not seem to be financially affected by the fact that he lost his job or the fine imposed on him for the expulsion of the Turkish teachers. He drives a luxury car, hires people to maintain his household, and spends at least 9,000 lei monthly on security services.
